Four Myths About Divorce Mediation

Mediation5

If you are going through a divorce in Central Florida, mediation may be the best method for you and your spouse to reach a mutually agreeable settlement. While mediation is a great family law tool, there are many myths that exist about this process.

We want you to get the most out of your divorce mediation. So that you can assess whether or not this process is right for you, our experienced Orlando divorce lawyer dispels four of the most common myths regarding Florida divorce mediation.

  1. Mediation is Only Useful For Couples Who are on “Good Terms”

While this is a very understandable myth, it is actually completely false. Divorcing couples who are not currently on “good terms” can still potentially benefit from the mediation process. Ultimately, whether or not mediation is right for your case will depend entirely on the facts at hand. You do not necessarily need to be happy with your spouse. Even couples who are in a fierce, highly emotionally dispute still have many overlapping interests. As such, there are areas for compromise and mutual benefit. Mediation can offer an avenue to begin to repair your relationship and to allow you to move forward with the divorce process.

  1. Mediation is Inappropriate for Complex Divorce Cases

Mediation works well for relatively straightforward divorces where the couple must settle a few simple issues. Still, mediation is not only for “easy” cases. Indeed, mediation can be a useful legal tool in even the most complex Florida divorce cases. Do not let the complexity of your legal case deter you from considering mediation as an option to seek a resolution.

  1. Mediation Takes Away Other Options

It is important to remember that divorce mediation is a fully voluntary process. At all times, both parties have the option to walk away from the negotiating table. You can start mediation, and then quickly change your mind and decide that the process is simply not right for you. There is nothing wrong with that; and, in fact, it is actually relatively common. One of the best aspects of mediation is that it is flexible and does not take away from your other legal tools.

  1. Mediation is Always the Best Course of Action

Mediation is not appropriate for every couple. While it is a very valuable legal tool, there are couples for whom mediation will simply not work. Fortunately, there are other methods available that can provide a means to find a divorce solution. Mediation is simply one option on the table that all couples should consider when attempting to settle their divorce.
